Terms and conditions

The products in the store are made by INCE Studio, owner Abdullah Ince, Elfriede-Bial-Straße 1, 40476 Düsseldorf, Germany. Contact: hello@byince.com.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Your purchase contract is therefore concluded with Paddle.com Market Limited, Judd House, 18–29 Mora Street, London EC1V 8BT, United Kingdom. Paddle's buyer terms (paddle.com/legal/buyer-terms) apply in addition. Paddle issues the invoice and offers the payment methods available in your country.

The rights to the files, meaning usage, updates and support, are granted by us under these terms.

You add products to the cart and open the checkout. Before that you confirm these terms, the refund policy and that delivery should start right away. The contract is concluded once payment is completed in Paddle's checkout.

All prices are final prices in euros and include VAT. There are no shipping costs. Costs outside the purchase, such as your account on the respective platform or apps, are your own.

You receive the files as a ZIP archive. Right after payment the downloads are ready on the confirmation page. We also email you a link to your downloads. It stays valid. When you open it on a new device, you confirm the download once with a code we send to the email address of your order.

To use a product you need your own account on the respective platform, for a Shopify theme that means a Shopify store.

With your purchase you receive a non-exclusive, perpetual right to use the product for one store or website and to adapt it as you like. This also applies if you set up the store for a client. Each additional store requires its own purchase.

You may not:

• pass on, sell or publish the files or parts of them, including in modified form
• use the product as the basis for templates of your own that you offer
• remove author or license notices from the files

Each copy contains a license identifier that lets us match it to your order. It appears in your store’s source code.

Images and copy from the demos are for preview only and are not part of the purchase. Included third-party components, such as fonts, are subject to their own licenses. Copyright in the products remains with INCE Studio.

New versions released within 12 months of purchase are free, and we let you know by email. You download them through the same link. After that you keep the last version from this period, and we continue to deliver fixes for it. You carry over your own code changes yourself when switching.

We answer questions about installation and features by email at hello@byince.com. Setting up your store and custom changes are not included in the price.

Your statutory right of withdrawal ends once the download starts and you agreed to this at checkout. The refund policy explains when we refund the price.

The statutory warranty for digital products applies. We give no warranty for third-party apps or for your own changes to the code.

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable if we breach an essential contractual obligation, meaning one you may rely on being fulfilled. Liability is then limited to the foreseeable damage typical for this type of contract.

Back up your store before installing or updating a theme.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country you live in remain unaffected.
